Sears Gets 13-Month Sentence For Child Pornography Possession Charge

Jay Sears PRESS FILE
Jun 28, 2017 12:23 PM

Jay Lockett Sears has been sentenced to 13 months in prison, nearly three weeks after his probation officer determined that he had violated the terms of his 2014 release after finding nearly a dozen bags of child pornography inside his East Quogue home, authorities said.

The 78-year-old architect, who was perhaps best known for his propensity for wearing white suits and angel’s wings while promoting his Quogue-based charity, the Mission of Kindness foundation, was sentenced on Tuesday in Central Islip by U.S. District Judge Denis R. Hurley, according to Tyler Daniels, press officer for the U.S. Attorney’s Office for the Eastern District of New York. Upon completing his sentence, Mr. Sears will also be subject to three years of supervised release.

At Tuesday’s court appearance, Mr. Sears pleaded guilty to lying to his probation officer and violating the terms of his probation, according to Mr. Daniels. Mr. Sears has already begun serving his sentence, Mr. Daniels added.

Mr. Sears’s attorney, federal defender Randi Chavis, declined to comment when reached on Tuesday afternoon.

After his initial arrest in 2013, Mr. Sears was sentenced to six months of house arrest and five years of probation after pleading guilty to a single count of felony child pornography possession. He was originally facing six felony counts—one for each of the identifiable minors depicted in the images recovered by authorities—and up to three years in prison.

Prosecutors said he would cut and paste the images of identifiable children, including those he met through his foundation, onto images of adults engaging in sex.

Some of the pornographic creations found inside Mr. Sears’s home earlier this month did, in fact, feature children known to him. According to Mr. Daniels, Mr. Sears cut out photographs of children appearing in the Waldo Tribune, a newspaper for children that’s circulated in the region, and pasted them on pornographic images. Mr. Daniels said he did not know how many children were victimized this time.

Prosecutors have reached out to the parents of all of the identifiable children, Mr. Daniels said.

Does anyone know what kind of plea deal he made in the first trial to get off so lightly?

Your response is irrelevant. Child pornography is illegal and SOMEONE did something to those children. It's illegal to enjoy watching.

Don't be a freak. It's ok to suggest a guy who dresses like an angel and finds children being raped entertaining needs help....or a swift kick

What else is it illegal to imagine within the comfort of your own head?

As adlkjd923ilifmac.aladfksdurwp has indicated, Jay Sears harmed no one. His behavior was restricted to cutting and pasting photographs, solitarily, in his own home, which he did not share with anyone.

The law shouldn't punish individuals for behavior which the community may find repellent but which is, in fact, objectively harmless.

Over the many months that Jay Sears has been in the news, no one has been able to articulate a rational reason that his conduct should have resulted ...more

Society disagrees with you and strongly believes that child pornography SHOULD be against the law and just because you and Jay disagree doesn't mean you can break it.

Any other laws you break because you feel you are a above them?

Totally agree that child pornography is an extremely serious crime.

The issue though is that Mr. Sears didn't actually possess or share any child pornography, he crudely affixed photographs on top of legal adult pornography. He needs help 100%...but this should not be a criminal offense.
