UPDATE: East Moriches Man Charged In Eastport Home Invasion Murder Held Without Bail

UPDATE, 3:05 p.m.:

Mr. Batterson was remanded to Suffolk County Jail in Riverhead without bail following his arraignment in Central Islip on Sunday morning, officials said.

The defendant's attorney, Eric Besso, who has an office in Sayville, declined to comment when reached Sunday afternoon.



ORIGINAL STORY:

An East Moriches man was arrested by Suffolk County Police on Saturday night and charged with the shooting death of an Eastport man in a home invasion in December.

Paul Batterson Jr., 22, faces a charge of second-degree murder in connection with the killing of 45-year-old Francisco Pirir at his East Moriches Boulevard home during the early morning hours of December 8, 2013. He is being held at the 5th Precinct and was slated to be arraigned this morning at 1st District Court in Central Islip.

County Police said the shooting occurred shortly before 3:30 in the morning, when two masked men smashed through the door of the small rental home, demanded money from the residents of the home, and shot Mr. Pirir in the face with a shotgun, killing him. A second resident of the home, Mr. Pirir’s uncle, was shot in the hand, and was treated at a local hospital and released. The suspects then fled the home.

The seven residents of the house were all migrant workers. Mr. Pirir had four children in Guatemala, and family both there and locally. The Eastport community rallied to raise money for his funeral, and to help his family financially.

GOTCHA! The only punishment these types fear is hanging by the neck...how about that new injection that "almost" worked fast? When you shoot a person in the face with a shotgun, I'm not so sure you deserve a quick and painless lethal injection. Time to put a little pain back into the punishment. How about public stoning in a pit in front of the courthouse IMMEDIATELY following the guilty verdict? No more jaming up the courts with endless appeals. They could use a touch of this in NJ, too, ...more

Yes, your point was well taken. Policing who Likes any particular comment, however, is over the edge IMO.

What happened to innocent until proven guilty we are talking about a 22year old kid....let's hear the whole story before we condemn him and his family...just because a reporter goes in front of a camera and gives you a select few details doesn't mean we know what happened...think before you comment!!!

"In court today, prosecutors said the shotgun allegedly used in the crime was discovered at Batterson's home, along with other evidence allegedly linked to the murder scene.

Batterson has been charged with second-degree murder and was remanded without bail today. His father appeared in court and declined to comment.

Batterson's attorney also refused to comment, and he pushed and attempted to cover up a News 12 camera with a notepad he was holding.

Under certain facts, one does not need to have pulled the trigger to be charged with murder along with the hit man.

Yes, it's generally termed "Felony Murder," and even extends t instances where two or more bad guys attempt to commit a Felony, and one of them is killed during the commission of that crime. The surviving bad guy can be charged with Felony Murder.

I believe that more than 40 states have such a statute on their books.

And in such FM cases the first murder charge tends to produce additional leads and evidence, perhaps even a confession along with a plea bargain . . .
