Three Charged After Drugs, Gun Found In Car In Hampton Bays

Southampton Town Police early Saturday arrested and charged three men with possession of a loaded gun, along with drugs and items related to their sale.

Justin C. Benkov, 26, and Joshua K. McDermott, 23, both from Flanders, and Kenneth Gordon, 36, of Riverhead were approached by officers from the department’s Community Response Unit while sitting in a car parked behind Charlie Brown’s bar on West Montauk Highway in Hampton Bays after police observed the men “acting in a suspicious manner,” according to police. Officers said they found one of the men rolling a marijuana cigarette and preparing to smoke it while drinking an alcoholic beverage.

Further investigation revealed more than 10 additional ounces of marijuana packaged for sale in the car, as well as 13 oxycodone pills, more than half of a gram of powdered cocaine, $1,696 in cash, a drug scale, packaging supplies, and a loaded Glock .40 caliber semi-automatic pistol, police said.

Mr. Benkov was charged with one count of criminal possession of a weapon in the second degree, two counts of criminal possession of a weapon in the third degree, and one count of criminal possession of marijuana in the third degree, all felonies, as well as two counts of criminal possession of a controlled substance in the seventh degree, a misdemeanor. He was sent to the Suffolk County Jail in Riverside in lieu of $35,000 bail, following a Saturday arraignment in Southampton Town Justice Court, officials said.

Mr. McDermott was charged with two counts of criminal possession of a controlled substance in the seventh degree and one count of possessing an open container of alcohol, both misdemeanors, as well as one count of unlawful possession of marijuana, a violation. He was released on his own recognizance following arraignment and is due back in court on May 29 at 9 a.m., court officials said.

Mr. Gordon was charged with one count each of criminal possession of a controlled substance in the seventh degree, possessing an open container of alcohol and unlawful possession of marijuana. He was released on an appearance ticket and is due in court on May 16 at 1 p.m.
