Cyril's Found Guilty Of 45 Code Violations

A jury on Friday morning found the operators of Cyril's Fish House on Napeague guilty of 45 misdemeanor charges of violating East Hampton Town Code, following a three-day trial.

Cyril Fitzsimmons, the bar's eponymous owner, had been fighting the town over dozens of violations issued to his company, Clan Fitz Inc., in 2013 in response to growing complaints about the number of people spilling out of the popular bar and mingling on the side of Montauk Highway on summer weekends.

Mr. Fitzsimmons's had gone to court to fight the violations, despite the owners of the property, the Dioguardi family, having reached a settlement with town attorneys earlier in the week after agreeing to make substantial alterations to the popular highway-side restaurant and bar and pay a $60,000 fine.

Among the alterations to be made, the traditional bar area, which fronts on Montauk Highway, will be removed from the building, and all 62 bar and dining seats will be behind a fence on the west side of the building. The owners also agreed to a strict occupancy limit of 150 people at any one time.

"The incremental but vast expansion of this premises was illegal and posed a threat to public safety," Town Supervisor Larry Cantwell said after the verdict was announced. "The changes required by the settlement—reinforced by today's jury verdict—will vastly improve the condition at the property and increase public safety by limiting the occupancy at this location."

Town Justice Steven Tekulsky will announce the punishment for the operator of the bar on June 20.

No. It's effective, not selective, enforcement. I assume you'll be kicking some bucks into Cyril's defense fund?

I've been there, and will tell you the town is absolutely justified.

They are not targeting him, or singling him out. What I saw when it came to the wiring alone was beyond a disgrace.

Cyril's is not a Montauk bar! It is actually located in Amagansett. It's about time the town has finally acted on all the illegal additions they have done to the place over the years.
But what about The Lobster Roll up the street? They seem to have added a lot of extra outdoor seating areas to that place too. They also have an illegal neon roof sign that was added when the original WOODEN sign blew down after a storm. Nobody seemed to notice that?

Drive by Cyril's on a Sunday morning. The air stinks like a septic system.
Also, Lobster roll got approval for the replacement in kind of the sign. Seating don't know.

I bet you I can find more than 45 mode violations in Cantwell's home! The Town is making a big deal of this - now there will be just a long line to get in, spilling on to the road way. It's a beloved place and the Town should embrace it better.

H2O , Lobster Roll may have approval for the sign, but replacing a wooden sign lit by two spotlights with a neon sign is NOT replacement in kind! They got away with it coz nobody noticed it and because they donated a bit of land back to the town.

Go after all the illegal stuff before summer, maybe we'll get the town back...
