Board Of Elections Denies Challenge To Petition In Westhampton Beach

The Suffolk County Board of Elections has denied a challenge to the petition filed by Westhampton Beach Deputy Mayor Toni-Jo Birk, who is seeking reelection on Friday, June 15.

The challenge was filed on May 14 by former Village Trustee Joan Levan, the treasurer of the Lightning Party, which has two candidates—Charlie Palmer and Ralph Urban—seeking the two open trustee seats on the Village Board. Ms. Levan said Ms. Birk’s petition, which was filed and time-stamped at 4:46 p.m. on Friday, May 11, by Village Clerk Rebecca Molinaro, was filed after Village Hall closed for the day at 4 p.m. and, therefore, missed the deadline.

It is certainly highlyunusual that an incumbant Trustee would decide to file her petition after the Village Hall closed at 4 pm, even if it was technically legal. It sounds like Trustee Birk is a very reluctant candidate this time around. Didn't she wait to the last minute to decide to run for a 4th term. She has not demonstrated any leadership. Contray to beachgirls comments the reason Toni filed so late was because she was working hard on current village business. She has proven herself to be a great asset to the Village, and because she knows the rules she knew she had to 5pm to file. (maybe she filed as late as possible just to upset Joan)
