Supervisor Kabot will fight DWI charge, stay in race

Ms. Kabot is certainly presumed inncent until proven guilty. Inded, she is
cloaked in the presumption of innocennce until it has been stripped away by a guilty verdict or guilty plea. It appears, however, that the evidence that will be used to strip away tha cloak is the fact that: 1) she was observed by at least two members of the WHB Village Police Deprtment to have the classic signs of intoxication which are observable and recognizable by almost anyone (glassy, blood shot eyes, slurred speech, odor of an alcoholic beverage on breath) and 2) that she refused to take a test to determine her blood alcohol content (BAC). Her refusal to take thje test can be used against her if she goes to trial to show her "conciousness of guilt" ; that she didn't take the test becasue she knew it would shopw her BAC to be above .08 %
While for the average citizen there may be many excuses not to take the test, for an elected official most of them don't fly. Certainly she knew that her arrest would make news and she knows that it is easier to defendat or explain a refusal to take the test than to defendant or explain a specfic BAC reading. That to me is the moist damning of all. Plus, just think how drunk she must have been for the cops to arrest her. If she only had a drink or two I don't know if she would have been locked up (she probbaly wouldn't have because a drink or two won't make most people intoxicated)
It will be interesting to see if she takes the case all the way to trial or takes a plea. If she goes to trial it will be interesting to see if she exercises her right to a trial by jury or lets her case be tried by a judge, which in this case I think would be Judge Robert Kelly in WHB. To highhatsize: 1) Get your amendments straight. 2) If there were no breath tests there would be nothing to back up what the police say about a suspected drunk driver. In fact, in this case, the only evidence of Ms. Kabot's intoxication is the obervations of the arresting officers. I fail to see how BAC testing make sit easier for the cops to falsley claim people are drunk. On the contrary, it seems that it would make it that much more difficult.

This was apparently a very extensive Grand Jury investigation and the only criminal charges they had were against Hults, who apparently was the fall guy in all this and who was in way over his head. I'm sure if there was evidence of crimes commited by other people they would have been prosecuted. The DA has a history of going after crooked politicains. Anyone remember Peter McGowan and Wayne Prospect?

I KNEW when this all started that Kabot did not want a fast trial . . . she wanted it to seem like she did before the election because she's so "innocent" and to put on a front for the voters, but now that she's lost the election she's in no hurry for a trial.

"high priced lawyer" or not these hearings are routine. Just becasue there is no BAC number doesn't mean there is no "proof" of intoxication. The officers' observations are legally sufficient to establish intoxication. Just think about your own life experiences. Have you ever seen a drunk person? How did you know they were drunk? Bloodshot eyes? Alcohol on their breath? Slurred Speech? Unsteady on their feet? These are the same things the police look at. Sometimes its hard to articulate what you see . . . except to say the person was drunk! That's why the video is so important becasue the jury can see for themselves. Don't forget, she also refused to take the test. If the court finds that she refused after being advised that her license would be suspended and that her refusal could be used against her at trial in clear and unequivocal language and she persited in her refusal, the prosecutor can use her refusal at trial to show "consciousness of guilt" and argue that if she wasn't drunk she would have taken the test.

By the way, a person has no rigtht to refuse the test, or eses your refusal would not be able to be used against you, unlike the right to remain silent, which cannot be used against you. In fact, usually they take the case farther becasue the accused is not paying for their representation and can take the case all the way without the expense of paying their lawyer to do so.
