If the police did their job wouldn't the charge have stuck? It seems they failed by locking an innocent person up for 5 days on a bogus charge. I think they were right to check her out and verify her story, to ascertain whether or not she was in fact a "terrorist" which would be highly unlikely, being that she was stopped on the side of the road in broad daylight taking these pictures. A "terrorist would likely have their guns at the ready not stored in the trunk, following the proper procedure for transport. Besides the terrorists we need to worry about aren't likely going to be using guns to harm us, They like car bombs, IEDs and airplanes.

They didn't "detain" her, they charged her with trespass, which didn't hold up in court. She was free to leave the jail upon posting $50,000. That isn't detainment, that is a wrongful arrest and malicious prosecution. The knew she wasn't a threat before she was removed the scene. I will agree she didn't use the best judgement in her approach to photographing the helicopter. I never said it was unreasonable for the police to detain her at the scene and ascertain wether or not she was a threat. Where they screwed up was arresting her and charging her with criminal trespassing.

Think the photography rule/law is a Federal one, why would the County charge her for breaking a law they don't have jurisdiction over?

Mr. Z - Fact: The guns were confiscated and held for 6 months after her charge was officially dismissed. That is is a violation of her 2nd amendment rights, there was no legal justification for the confiscation of the legally transported firearms.
Fact: Thought crime is not yet on the books, except in the case of hate crime legislation. Not agree with someone ideologies doesn't grant the right to infringe on a constitutional right.

The cash is a non issue, because it is not illegal to have $13,000 on your person unless you are flying on a commercial flight.

As for the bogus criminal trespassing charge which was the impetus for her incarceration. Intent to trespass would be difficult to prove as intent is generally one of the most difficult things to prove in a trial.
If taking photos is illegal as has been claimed by many, then they should have charged her with it. To hold a 30 year resident on $50,000 bail on a criminal trespass charge is a gross misuse of power by the Judge.
Bottom line is she was held in jail for a charge that was dismissed, that alone justifies compensation.
I'm not saying 70,000,000, but she will be paid for the mishandling of this incident.

What she was doing doesn't meet the description of the charge. She may have been taking photos, but that doesn't fit the charge. The Air National Guard officials do not have jusristiction over CR31. The out flow pipes for the Riverhead STP are quite a bit east of the the traffic circle, so I wouldn't expect to see the Red Tide upstream/river from them. Note I did say this Red Tide, so where it has been spotted in the past is irrelevant.
I'll tell you what though, we can be sure it has never gone from Shinnecock to Peconic, because the water only flows one way.... into Shinnecock.
