The judge overseeing Southampton Town Supervisor Linda Kabot’s DWI case has ordered the Suffolk County district attorney’s office to investigate a claim by Ms. Kabot’s attorney that someone connected to the Westhampton Beach Village Police Department called her political rival, Anna Throne-Holst, on the night of Ms. Kabot’s arrest and told her, “We got her.”
The investigation, which was announced just this week, will target the Westhampton Beach Police Department, the agency that made the arrest on Main Street in Westhampton Beach during the early morning hours of Monday, September 7.
Riverhead Town Court Justice Allen Smith, who is presiding over Ms. Kabot’s DWI case that begins on Thursday, October 29, ordered that Suffolk County District Attorney Thomas Spota “make inquiry of the personnel and agents of the Westhampton Beach Police Department as to any communications (telephone, e-mail, etc.) to any persons relative to the arrest of the Defendant during the evening of September 6, 2009, or the morning of September 7, 2009.” The defendant refers to Ms. Kabot.
Bill Keahon, Ms. Kabot’s DWI attorney, received a copy of the order via fax on Monday, October 26.
The investigation was prompted by an anonymous letter Ms. Kabot received on September 14 that stated, “[w]hile you were being field tested for sobriety, a call was placed to Anna by a ranking police officer who told her, ‘We got her.’” The “Anna” refers to Southampton Town Board member Anna Throne-Holst, the Democratic candidate who is challenging Ms. Kabot, a Republican, in the November 3 election for town supervisor.
The author of the letter, who only identified herself as a single mother living in Sag Harbor, said she received that information second-hand. Copies of the letter, which were dated September 10, were mailed to Southampton Town Hall and the supervisor’s private post office box and home address.
The allegations stated in the letter compromise judicial integrity, according to the court order.
Westhampton Beach Police Chief Ray Dean declined to comment on the order. He previously said that his officers made a lawful and appropriate arrest. The arresting officer was identified on the police report as officer Ryan Lucas. Officer Steve McManus was also at the scene at the time of Ms. Kabot’s arrest.
Bob Clifford, a spokesman for Mr. Spota, declined to comment Wednesday on Judge Smith’s order or the upcoming investigation.
"No one called me that night to say, 'We got her,''" Ms. Throne-Holst said Wednesday afternoon.
Ms. Kabot is due back in court today, October 29. Part of her defense will be based on several minutes of missing video taken after she was pulled over by officers. There will also be other hearings, according to Mr. Keahon.
Ms. Kabot was arrested at 12:25 a.m. on September 7 after two Westhampton Beach Police officers observed her car cross over the double yellow line as she made a left-hand turn onto Main Street from Sunset Avenue.
According to the police report, the arresting officer said that Ms. Kabot’s breath “smelled strongly of an alcoholic beverage,” and her eyes were “red and glassy.” The report also notes that she failed two field sobriety tests.
Ms. Kabot, who was attending a 40th birthday celebration at her sister’s home in East Moriches on Sunday, September 6, had two normal-sized glasses of wine over several hours before her arrest, but she was never intoxicated, Mr. Keahon previously said.
Ms. Kabot refused a breath test and other chemical tests that night because she felt “angry and intimidated” by the “overzealous nature” of the arresting officers, she said during an earlier interview.
Ms. Kabot’s driver’s license was suspended for a year by the New York State Department of Motor Vehicles because she refused a breath test. A separate violation for refusing the breath test was dismissed by Judge Smith. Her license remains suspended and will not be lifted even if the court dismisses the DWI charge.

30 or so years ago, Allen Smith was a pretty good Supervior of Riverhead -- as a DEMOCRAT! His personality, however, rubbed enough people the wrong way that he couldn't get re-elected.

Good point courtesy! Editor, where do the candidate interviews take place? Do you go to Town Hall or do the candidates come to your office? Are they interviewed during normal business hours? If so, how did Linda get to your ... more office? Who drove her? Husband, cab, co-worker? You have an office staff that greets people, someone must know.

To argue speculation doesn't hold weight is valid, so in fairness, you must then agree that Linda Kabot insistence on pursuing the 'speculation' that Anna Throne-Holst was called the night of her DWI arrest shouldn't be brought up in court, right? I don't know what is more speculative than an anonymous letter.

I personally want Linda out because she made such a stupid decision to drive drunk and I don't want her to get away with ... more it and be on the road with my teen daughter! Wake up everyone! Linda is using this-- with the tremendous help from the Southampton Press--to throw voters off from the disgraceful job she's done in her tenure as Supervisor. Don't fall for it!

The Press has assisted Linda Kabot's idiotic claim about the "anonymous" letter by publishing it and by pursuing this nonsense at a time when we should all be concentrating on the real issues; the mismanagement of OUR money, the cutting of programs dedicated to supporting our youth, etc.
Who cares about a fictitious letter, who ... more called whom, why Linda fely angry and threatened by police who are only trying to protect citizens (my teen daughter) from drunk drivers???
I care about what's next on the agenda for Southampton Town, our youth, and my tax bill!!

If Linda was a good manager the financial mess would have come to light years ago when she was happily voting for Skip's budgets.

Anna Throne-Holst brags she is endorsed by the Working Families Party - which is well-known as having nothing to do with “working families” and is not a political party. It is in actuality a wholly owned subsidiary of Acorn. Yes, THAT Acorn, with the hidden videos of illegal scams and the financial scandals. But wait, there’s more. Bertha Lewis, the co-chair of the Working Families Party is – surprise! - also the Executive Director of Acorn in New York. The WFP is essentially a money funnel which pays for aggressive door to door canvassing for beholden candidates, uses intimidation and is thought of as Acorn’s political arm in New York State. Are you alarmed yet? Wait, here’s the worst of it. This WFP has been outed as criminal enterprise that utilizes a for-profit consulting firm, Data and Field Services, to skirt New York election laws regarding public finance and campaign spending limits. (Maybe this is why Anna’s financial disclosures are not in order.) They are classic pay-to-play politics.
Even the New York Daily News has called the Working Families Party "AN ELECTION FUNDING SCAM".
Are you begining to see where this is going? Do we really want a supervisor in our town that has these ties and political patterns? Is it possible that Anna Throne-Holst doesn't see anything wrong with this because she was born and raised in socialistic Sweden? I believe none of us wants Acorn to get a foothold out here. I am sure you feel that way too. If you do, well then, you have one vote to cast - against the Acorn people and FOR good government without criminal involvement and dirty backroom dealing. That vote is for Linda Kabot. Oh sure, you may find her abrasive, you may not agree with her, but one thing is for certain, she will make the tough decisions (even political suicide like cutting bloated Police jobs and sweetheart deals), she is an EXPERIENCED and competent administrator, and you'll never find an Acorn on her watch! So on election day, let Anna go back to her not-for-profit world. Maybe she can get a job with Acorn.
