Suffolk County District Attorney Thomas Spota’s office has dropped a trespassing charge filed against an East Quogue woman in July after she was arrested for taking pictures of the Air National Guard base in Westhampton, while she had two guns and hundreds of rounds of ammunition in her car.
The decision to dismiss the misdemeanor charge filed against 53-year-old Nancy Genovese was made following an investigation conducted by the DA’s office, and comes less than one month after she filed separate lawsuits against Suffolk County and Southampton Town alleging that she was falsely arrested.
The misdemeanor charge was dropped on November 17 after an investigation found that Ms. Genovese had remained inside her car and outside the base’s property at Gabreski Airport just prior to her arrest, Robert Clifford, a spokesman for the DA, wrote in an e-mail.
The dismissal came after Ms. Genovese filed identical lawsuits on October 23—one with the Southampton Town clerk’s office, naming the town as a defendant, and one with the Suffolk County Clerk’s office, naming the county as a defendant. The lawsuits allege that Ms. Genovese was arrested and imprisoned “without probable cause or other legal justification,” that her vehicle was searched and her two guns were seized unlawfully, that she was verbally abused by Suffolk County Sheriff’s Department officers while she was detained, and a slew of other charges related to her arrest and subsequent detention.
Ms. Genovese’s lawsuits do not list the amount of money she is seeking in damages but charge that she’s owed “reasonable compensation to be determined by a jury, punitive damages, and attorneys’ fees and expenses.” The Manhattan law firm representing her in her civil case did not return calls seeking comment.
“Apparently, they can arrest you for anything they want and say, ‘Oops, sorry,’” Ms. Genovese said of her arrest and the subsequent dismissal of her charges. “They tried me, they found me guilty, and they were going to punish me in there.”
Ms. Genovese was arrested on July 30 by Suffolk County sheriff’s deputies after Air National Guard officials said they saw her taking photographs near the entrance of the base at Gabreski Airport. Authorities said they found an XM-15 assault rifle and a shotgun—both registered and unloaded—in her car, and an estimated 500 rounds of ammunition in her trunk at the time of her arrest. She said she was on the way home from a shooting range at the time of her arrest.
She was charged with third-degree criminal trespassing and was released four days later from the Suffolk County Jail in Riverside after posting $50,000 bail.
Most of Ms. Genovese’s allegations detailed in her lawsuits were directed at the Suffolk County Sheriff’s Department.
Suffolk County Attorney Christine Malafi declined this week to comment on the specific charges, citing the pending litigation. But Ms. Malafi noted that the county has requested a deposition from Ms. Genovese in response to her claim. During the deposition, which might be given in December, the county will question Ms. Genovese about the allegations and her background.
“My office looks forward to vigorously defending the county against her claims,” Ms. Malafi said. “The Sheriff’s Department did what they thought they had to do to protect public safety.”
Chief Michael Sharkey with the Suffolk County Sheriff’s Department said Tuesday that his office was aware of the lawsuit filed by Ms. Genovese but could not comment on it.
When reached last Thursday, November 19, Ms. Genovese said that Sheriff’s Department officers failed to tell her she was under arrest until about 2 a.m. on July 31, after she had been questioned without a lawyer present for about eight hours. Ms. Genovese said officers with the Sheriff’s Department only told her she was under arrest after they had found her Myspace.com profile online, which Ms. Genovese said expresses politically conservative viewpoints.
At that point, Ms. Genovese said, officers began calling her a “right-wing extremist.” She said a similar characterization by a county prosecutor, whose name she could not recall, at her arraignment contributed to a Southampton Town Justice Court’s decision to set her bail excessively high, and led her to believe she was being treated unjustly by authorities for her political beliefs.
“Even if it was a trespass [third-degree] violation, who gets a $50,000 bail?” said Ms. Genovese who described herself as a “conservative” person. “It’s absurd.”
The lawsuits also level some charges against Southampton Town Police. Ms. Genovese’s lawsuits allege that an off-duty Southampton Town Police officer originally approached Ms. Genovese while she was taking pictures while sitting in her car and outside the base, demanded that she hand over her camera, and then alerted Suffolk County sheriffs and base officials of her presence.

The ANG base is hardly a top secret location. It is accessible from many points on its periphery and old air force structures are rented out to people who access them on ANG roadways.
Justice would include Ms. Genovese being given an official apology from the ANG commander, the Suffolk Sheriff who arrested her, and, last but far ... more from least, the off-duty STPD lieutenant who "reported" her behavior, together with reimbursement with any legal costs she may have incurred. Drinks and dinner wouldn't be a bad idea either. Her attorney should make all these a requirement, in addition to a substantial monetary sum, as the reward to compensate her for defamation of character.
The stupidity of this incident would be mind-boggling anywhere else in the United States, but on the East End, alas, it is s.o.p. Note that it was instigated by an cop from the STPD, an organization that removed the word, "discretion", from its dictionary decades ago.

The rounds were about 140, not 500. There is nothing wrong with pulling over to the side of the road, opposite the display chopper and taking pictures. The firearms have nothing to do with any of this.
There is no intent to cause harm. After 6 hours on the road, the FBI DHS the base and other initials I don't remember, released me...why did a low level police offer ... more arrest me for a charge that is not even a legal charge? Why did they lie through their teeth about me? I have a perfect background so they made up lies to "sell papers."
Why did I have to pay all that money to prove I an innocent?
Anyone who has had to deal with bad police officers, will not speak well of them. You and I both know, we have good and bad cops, we have abusive cops and this is what I had to deal with, corrupt bad cops.
Do you have any idea how long it would take for me to get out of my convertible, remove the triple locks and cases on each firearm, remove them from the LOCKED cases, open the truck and load these firearms?

There are nuts all over the world with illegal weapons, people who go to the range, join the NRA, register their firearms when its not even required by New York state, have no prior arrests, and so on, are not the ones you need to worry about.
BTW it is an AR 15, semi ... more auto, an arms specialist looked at them on the road in those six hours. I have no assault weapons, only firearms for target practice.

They had us on the road for 5-6 hours, questioning me. The big scene they made is where the problem lies. They made a mistake and had to justify the over reaction.
There had to be 100 people running back and forth with troops, FBI, FEMA DHS and so on., all with a cell in their ear, "taking orders from way up there."
The scene was a ridiculous amount of force. Look at the default pic of me, ... more that was taken by Vera Chinese of the Southampton Press about one hour after I was home. You can see the bruises on my arms from some abuse inside the jail. A correctional officer told me as soon as I went in, "we tried you, we found you guilty and we will punish you in here." And they did.
I was also told over and over again, "we will make an an example of you for all right wingers and tea baggers."
This is such an injustice. I believe there will be many more of these arrests because of the white house release of their labels, "right wing extremists", bible loves, returning vets, now being labeled home terrorists.
I am creating a professional page for anyone wrongfully arrested. I will fight this and other injustices against law biding American citizens being abused by our law enforcement.

The cops knew that the firearms were legal and they no doubt verified her local domicile from her drivers license. What on earth were they thinking.? The, "Oh, My!", reaction of several posters reveals their parochial attitude towards firearms, specifically the attitude of NYS residents to firearms. The enormous majority of other states think of them as sports equipment and personal protection rather than tools of terrorism.

Thank you for your intelligent comments. Yes I was cleared by all higher officials. It was the under sheriff, Caracappa who is a media hungry official with no experience who did this, who lied about my mental state because he had nothing to justify any of what he did.
I was told for 12 hours I am just being questioned,I was not under arrest, I was going home. It was not until Caracappa saw my Myspace page, in the middle of the night, with my political views that ... more he told me I was under arrest, and he used a trumped up charge like trespassing 3 on a county road. its cost me a fortune to defend the charge. I paid to take it to trail. .
I am living in the same home 31 years raised three children in private school all their lives, alone. Caracappa thought he was arresting someone who could not fight back, who would not go after him for false arrest and deformation. He is wrong.
Anyone, please do email me any of you if you have questions, I can document my answers and am happy to reply to your questions. I broke no laws, I was so badly abused in that place for days I will now spend all my time and money on stopping this from happening to anyone else, or at least helping those wrongfully arrested.

As long as the courts continue to interpret the Second Amendment as they have, she's got a lawsuit possibility.
Although I fail to see how "The right to bear arms IN AN ORGANIZED MILITIA" (which I read to mean the National Guard) gives someone the right to have an assault rifle in their car ... more trunk. But the law's the law, and she did nothing wrong.

No one warned me at any time. I gave the FBI info when asked if I was ever there before. I don't lie. I was there to take pictures weeks prior. I didn't have my camera and was leaving the side of the road. The troop came over to me, while parked, in my convertible, looking for my camera, on the road.
What did he say... "Nice car, when can I drive it." He was flirting with me!!
There is no infatuation with the base. I was making a "support out troops web page" for that ... more base for Christmas. I wanted a pic of the chopper on display.

"A true assault rifle" has been heavily restricted since 1934, and illegal in NYS for ever longer. And civilians have not been permitted to own a new one since 1986

The first statement is in quotations because I was quoting someone else's comment.
The second is my response to that statement, saying that no civilian in this country should require a reason to exercise a right that is theirs, is protected by the US Constitution, and has been repeatedly upheld by the courts. This is not my opinion, it's the law of the land. I just happen to agree.

Also, the statement that one would not object to the arrest were the suspect Muslim or Black is specious. "I" certainly would.
In any case, while the incident suggests that some bored cops conjured up a terrorist fantasy to add spice to their mundane, quotidian existence, I have no principled objection to their behavior until the decision was made ... more to charge Ms. Genovese. To do so with the evidence of her innocence at hand was profoundly stupid, but up until then she had complied with requests rather than obey commands.
I grant that finding firearms and ammunition in her trunk, in this part of the United States, is suspicious, especially when added to her taking photos of a "restricted" facility, (whatever that means.) I would hope that the police would behave with the same skepticism were the suspect turbaned, bearded and wearing a thawb. However, had he the same proofs of innocence as Ms. Genovese possessed, I hope that the cops would release him at the same time that they should have released her.
Regarding her firearms, the shotgun is the premier protection against home invasion, (plus a dog). Assault rifles, (which are simply rifles that have a hand grip forward of the trigger), are owned by millions of firearms enthusiasts because the destroy stuff dramatically. They are fun to shoot at the range, and they would come in handy were civil chaos to erupt following a natural or governmental disaster. (Remember St. Thomas after their latest hurricane. Not only were civilians looting, the National Guardsmen were too! Residents saved their homes by standing in front of them with firearms. [I think that the National Guard predation was peculiar to St. Thomas. The same would not occur here.])
500 rounds of ammunition isn't that much to firearms enthusiasts. Some shoot more than that in a week. This has created a cottage industry of shooters who reload used brass cartridges to save money.
Some posters herein have demonized Ms. Genovese. I don't know why she is interested in the ANG base, or in firearms, but she was an innocent.

And despite an earlier Commenter's assertion of her belief about the Second Amendment only pertaining to a militia, the Supreme Court decided that one last year: the Second Amendment, as with every other amendment to the Constitution, is an INDIVIDUAL right, not a collective one!

What would happen if you were pulled over, would depend on how busy the officers are that given moment.
This is a total injustice. I would not trust police on any level after this. Carry a camera, carry an audio recording device in your car, that you can turn on if pulled over. Protect yourself. Register your firearms too.
It seems even if you do not break any laws you now are "Guilty until proven innocent" in our great country.

Were you in jail for four days? Your post seems to suggest that you were only detained for six hours.
Were you told prior to the day of your arrest that you were prohibited from entering the ANG base or taking photographs?
Parenthetically, it appears that both the Suffolk Sheriffs and you are unaware of the latterly, salacious meaning of, "tea-bagger", that has pretty much prohibited its ... more use in polite discourse.

Sure. I was on the road with my two adult sons (I called to the scene) for about 6 hours questioned by FBI, DHS, FEMA the base and so many others. I was released by them.
About 12 am I was cuffed, we were told I would return home later tonight, I was going in for more questioning. After Caracappa saw my myspace, he told me I was under arrest in the middle of the night.
I was arraigned Friday afternoon with bail left at 50,000.00. My sons were given the ... more wrong time to be there with bail allowing them to keep me for the weekend. I was there 4 nights and 5 full days, until Monday Aug 3 about 5 pm.
No I was never ever told not to return. I made another post above addressing this. The troop wanted to drive me car as I was digging for my camera on the road side in my convertible.

I am aware of the term but you have no idea how much worse they were. That term is nothing compared to what else I was called. I was not allowed to sleep. I was not given change of clothes or even a tooth brush.
I was denied antibiotics for a leg injury I had happen home that morning. it turned to a staph infection. It just now might be healed by may be in the bone. I was told by 4 drs, one more day in there and I would have lost my leg. Pictures are up on myspace its now public if you want to see them.
Btw look at the catholic school graduations, bishops, Pope and family pics as my children received their sacraments.

I agree you are innocent. You did nothing wrong and were let go. However, we are only hearing your side of the story and, from what I hear you saying, I think the police did exactly the right thing. I am sorry, Ms. Genovese, but you sound ... more a bit extreme in your ideology and perhaps that came across to the authorities. Combine that ideology with semi automatic weapons and hundreds of rounds of ammunition and all of the violence and hatred being espoused by the far right, along with the fact that you were taking photos where you should not have been doing so, and the police have a pretty strong case for holding you until they were certain you did not represent a threat to anyone.
I would agree that they probably held you for too long, but if you want to have the right to carry around weaponry of this type in your car, then you had best accept that there may be consequences.

The various incorporated municipalities out here should apply to the NYS Attorney General for just such and investigation.

However I have to wonder; the SC sheriffs drove to and FROM SH court at over 110 MPH, to get me out of court by 1230. They told my sons to be there at court at 1 PM July 31.
How safe does that make any of you feel on sunrise highway?

I jog at a Refuge that borders the base several times a week. All there is on the south side of the base is a 5 foot fence with many gaps. In fact, there is one gap the hunters from the base use to get on Refuge property - with their guns & bows by the by. They also have a small racetrack where they race base vehicles & personal vehicles ... more around & around.
If this was all about base security - then why is the southern border open & unprotected? No security cameras either....... Have a jog or walk & see for yourself.

You can't arrest someone on "suspicion," only on PROBABLE CAUSE that a CRIME has happened, is underway, or about to happen. In this case, ... more since she was arrested on trespassing charges, that means the sheriffs believed they had probable cause she was trespassing. But we now know that was bogus from the start since she was on the side of a public road.
If it were legitimate, the DA would have gone to trial or settled, not dropped the charges completely.
She's INNOCENT.
