Advocacy Groups Promote State Bill Allowing Undocumented Immigrants To Get Driver's Licenses

Representatives from several community advocacy groups spoke at a public meeting in Bridgehampton last week to push for reinstating state legislation that would allow undocumented immigrants the opportunity to obtain drivers’ licenses.

The Progressive East End Reformers, or PEER, a chapter of the New York Progressive Action Network, hosted the meeting on Thursday, January 17, at BNB Bank in Bridgehampton and invited members of the Brooklyn-based Make the Road New York organization and Organización Latino-Americana of Eastern Long Island to inform the public about the legislation and what steps have been taken so far.

Make the Road New York is part of the steering committee for Green Light NY—the statewide coalition campaigning to get the legislation passed—representing Long Island. Its community leaders Eliana Fernandez and Gabriela Andrade spoke at the meeting on behalf of Green Light NY and discussed the legislation’s benefits both locally and statewide.

Prior to 2005, undocumented immigrants in New York were allowed to apply for and receive drivers’ licenses. That changed when Congress modified a federal law that then required an immigrant to provide proof of legal status in order to get a driver’s license. The organizations are trying to revert to the previous policy.

Under the legislation, an undocumented immigrant would only be allowed to obtain the lowest level of a driver’s license in the state’s three-tiered system, called a standard license. The license is only used for identification and does not allow users to enter federal facilities, fly domestically or cross the border from Canada, Mexico or some Caribbean countries.

As of January 21, the bill was before the State Senate and State Assembly transportation committees for consideration.

On a local level, the three groups believe that the immigrant community suffers greatly from the inability to obtain drivers’ licenses, forcing people to either drive illegally or use a public transportation system that proves unreliable.

PEER Co-Chair Kathryn Szoka explained in a later interview that the geographic dispersal of the population on Long Island makes it a necessity to be able to drive.

“It is not possible for a night nurse in Suffolk County to use the bus system. It’s not possible as a day laborer to use the bus system. It starts too late and ends too early,” Ms. Szoka said. “For those who can easily get in their car and go to work, you tend to forget that for a lot of people who either don’t have a car or can’t get a license, it’s a huge barrier.”

Local undocumented immigrants are known to drive without licenses, putting them at risk of being arrested—even, ultimately, deported—if they’re stopped for a traffic violation. This also creates a bigger problem when an accident occurs, because they don’t have car insurance.

At the meeting, Ms. Fernandez said that more than 700,000 people 16 years old or older in the state could benefit from the legislation, not only through having a driver’s license but through increased job security and more convenient and safe daily commutes.

Those benefits, in effect, would aid the rest of the community and the economy as well. Ms. Fernandez claimed that the state economy would receive about $57 million in combined annual revenue and about $27 million in one-time revenue through taxes. She added that it would also lower car insurance premiums and increase road traffic safety.

Minerva Perez, executive director of OLA of Eastern Long Island, said at the meeting that her organization has been trying to garner support from local police chiefs and health care and education leaders for the campaign. “This is not a partisan issue. This is what can be safer, what can be a revenue stream, what can make our communities healthier,” Ms. Perez said.

For years, the bill went through the same cycle of being passed in the State Assembly and coming to a halt in the State Senate. Now that the Senate has flipped to a Democratic majority this year, the Make the Road representatives were optimistic that the legislation could pass and stressed the importance of addressing it now.

“It should be a crucial year. This is the time that we need to push our elected officials to make this a reality,” Ms. Fernandez said.

They plan to send signed petitions in support of the legislation directly to four Long Island state senators including Anna Kaplan, Monica Martinez, Todd Kaminsky and James Gaughran.

About 30 individuals from PEER and the community attended the event and were all in support of the legislation, according to Ms. Fernandez.

Yes they would be required to obtain insurance. I believe that is the whole point! You can't get insurance without a license because your driving record vis-a-vis your license is how insurance companies measure the risk you pose as a driver. We know that people are going to be driving out here no matter their status or whether they have a license cause you have to. So let's get them insured so that they aren't a massive liability risks and while we are at it lets get them some state identification ...more

Should not the owners of estates of Southampton and Bridgehampton pay for transportation and/or habitation of their workers? In the last gilded age, did not the gardeners, maids and other domestic servants reside in servants quarters on the premises? Or perhaps they can just pitch tents on the public parks in Easthampton.

My proposal is that these workers either
1) be a US citizen
2) be a holder of a valid US issued green card
or
3) be a holder of a valid US work permit or visa
The process for obtaining either (2) or (3) is to obtain permission to apply and then be reviewed by any US consulate or embassy around the world.
This system has the added benefit of being US law.

Don't like it? Change the law through the US Congress and have it signed by the US President, or have the ...more

First of all is NOT that simple, I have friends that have been paying lawyer for more then 10 years thousands and thousands of dollars..still not there. One way is to be sponsors by a company, and they will pay the fees but also MUST show that the company needs the skills of that worker..

Big Mistake. They are simply putting ordinary people at risk of loss of property. I have a winter home in a state where they've been granting illegals licenses for years, and a couple friends of mine have been struck by drivers that fit the textbook description of illegals. Can't say with 100% certainly because none of them ever stopped. (one of them had just walked out of a hospital after back surgery and was crossing the street in front of the hospital). Funny, according to the U.S. Census Bureau NY lost more people from July 2017 to July 2018 than any other state. It loss was only mitigated by the fact that over 70,000 (illegal) immigrants moved to the state and the birth rate (by who I guess) slightly surpassed the death rate. In fact the decline of NY's population is so bad the state could risk losing two congressional seats after the 2020 census. One report says from 2010 to 2017 over a million people left NY. Thanks for making my point.

These advocacy groups consider a moving car filled with Latinos a ''moving target''. Being pulled over and being identified as having no driver's license exposes the illegal who may have likely stayed under the radar. The argument that these workers are afraid to break the law by driving without a license is hard to reconcile with the fact that they are willing to live here and work here without the proper licenses.

I’m wondering how the current DMV infrastructure will support the sudden onslaught of illegal aliens applying for licenses. I remember reading about CT DMV and the delays/long waiting times when a similar program was implemented. CT DMV even had to shut down, the system becoming overly burdened, not being able to handle the increased volume.

I’m really in opposition of putting the cart before the horse on this.

My insurance costs have continued going up bc of the uninsured drivers in the roads .I have been paying the price too long! What’s more money to deport the law breakers. They should have been removed from the roads long before we had to pay to deport them .

Sure, we can deport any undocumented person who drives without a license (which is a form of mass deportation) but that won't stop undocumented people from driving without licenses out of necessity, and therefore without insurance.

Do you want undocumented drivers to be insured or not, because undocumented drivers exist whether you want them to or not. Deal with the world as it is not as you'd like it to be, Toes.

I suspect your insurance costs are going up for a multitude of reasons mostly because of the intrinsic greed of insurance companies. Also just as a point of accuracy they are "charged" with a violation, not a crime. Driving without a license - like being undocumented - is a violation not a misdemeanor. It's a bit of legal semantics but the distinction carries a tremendous amount of legal baggage. If proof.of payment of auto insurance for a year is a prerequisite for the drivers license granted to an undocumented immigrant, and it would have to be renewed along with the proof of insurance payment annually, and it was explicitly printed on the license "not for use of any government benefits" then I would have no cause to oppose this egregious usurpation of Federal law. Otherwise it's just an end run around the US Congress.

On July 4th of this past summer, I was hit head on by an illegal alien who was drunk. This was at 7:30 pm on Springville Rd in Hampton Bays. This individual ran from the scene and was later apprehended by SHT Police.
He stole the car and was arrested for Dwi.
My car, a 2011 BMW X3 was totally destroyed and the insurance companies have fought paying a dime and I have been slammed with sky high premiums as a result.

Many of us employ undocumented people here, benefit from the work that they do, and willfully throw out blanket assumptions about them due to a minor crime that they have taken part in - WE are hypocrites. We want the rule of law!! (yeah right).

An example of the particular reference by Rayman you speak of? I see no reference to DWI arrests Rayman has made regarding illegals - and out of 60 posts, maybe 5 are related to illegals.

As a side note, it would also be interesting to know that Suffolk County has "→Annually, traffic injuries resulted in an average of $114.2 Million

I agree with you that it's important to have the facts -- of the 800,000 or so motor vehicle accidents in New York State each year, how many involve a motorist that was in the country without valid visa, i.e. an "undocumented immigrant"? This number should be known to New York State law enforcement -- let's know what it is.

I recall previous discussion suggesting illegals would need to first leave and re-enter the country legally to be considered for any pathway to legality, but not "mass deportation." At minimum, the suggestions were to deport as they came known to law enforcement, but, the current trend is to puposely keep law enforcement out of the picture. So, perhaps in light of that, I could certainly see some taking a hardened position as a result.

As one can't obtain insurance without a license, that amounts to deporting any undocumented immigrant who is pulled over while driving, ergo mass deportation.

Yep. I read a peronal story of this just last week on FB where the illegal passenger in a vehicle with an illegal driver who was at fault, no insurance, etc. was sued. The not-at-fault individuals insurance company wouldn't cover it (because it was the passenger) and he had to defend himself at his own expense. I tried to return plates from an old unregistered trailer to Motor Vehicles in Riverhead last year. After waiting on line I was told that since they were over 3 years old there was no record of them so I should just throw them out. I asked the clerk to throw them out for me, so she took them, and threw them in her waste bucket. Wonder what happens to all the old plates M.V. rejects. I couldn't believe it.

The issue for me is "fairness". "To be valid, the International Driving Permit must be accompanied by a valid driving licence issued in the applicant's country of residence."

AAA (the issuing party for IDPs in this country) also requires a license from one of the fifty states. An undocumented immigrant can't obtain a valid driving license in their country of residence (the U.S.) so that's not an option for them.

I think you hit one of my hangups with Booker on the head, but big pharma does employ many of his constituents so he gets a pass from me in regards to his tight relationship with them IF AND ONLY IF he can articulate why that relationship exists, and how we can trust it won't be a defining part of his presidency.

He makes sense on the subject of the American Dream, unfortunately self reliance and hard work are anathema to today's Democrat Party so they will fire up the smear machine and take him out early , the Party would disappear if everyone worked hard and was responsible for their own well being.
