Town Trustees, Village, Property Owner To Settle Lawsuit Over Property At Georgica Beach

The East Hampton Town Trustees and East Hampton village have settled a five-year-long lawsuit involving a rock revetment project on Georgica Beach.

In 2011, Tropical Storm Irene flattened a dune at Mollie Zweig’s beachfront residence at 11 West End Road, and in 2013, Superstorm Sandy caused even more damage. Because of this, Ms. Zweig planned to remove a decades-old rock groin and construct a rock revetment, plant beachgrass, and install snow fencing to prevent further erosion. The East Hampton Village Zoning Board of Appeals granted permits for Ms. Zweig to start the work even though the East Hampton Town Trustees objected, claiming jurisdiction over the land.

The Trustees sued Ms. Zweig and the Village ZBA seeking to overturn the ZBA’s approval of the revetment project, in the process raising questions about the location of Ms. Zweig’s property line and the boundary line defining the limits of their jurisdiction over projects on the beach.

Neither East Hampton Town nor the town ZBA joined in the lawsuit. Instead, the Trustees brought the town and town ZBA into the lawsuit, without their consent, as additional defendants.

At a Thursday, March 7, East Hampton Town Board meeting, the board authorized the town attorney to sign the settlement, states that the revetment may be maintained in place as approved by the Village ZBA and affirms the owner’s right to install sand fencing. The settlement did not address claims related to the jurisdiction of the town and the town Zoning Board of Appeals with regard to any portions of the subject property.

In addition, the stipulation maintains the right of pedestrian access over the Trustees property along the Atlantic Ocean.
