Schneiderman Still Not Ready To Concede Comptroller Race Until All Absentee Ballots Are Counted

Southampton Town Supervisor Jay Schneiderman said on Tuesday that he does not plan to concede the race for Suffolk County comptroller against the incumbent, John M. Kennedy, until all of the absentee ballots are counted.

According to the Suffolk County Board of Elections, there are 29,985 absentee ballots and another 3,255 affidavit ballots, totaling 33,240, that have yet to be counted.

One of those votes, Mr. Schneiderman said last Thursday, November 8, was his sister’s. He added that he wants to make sure that her vote counts.

Mr. Kennedy, the Republican candidate, declared victory over Mr. Schneiderman, a Democrat, on Tuesday night, after collecting 246,690 of 484,757 votes, or 50.89 percent. Mr. Schneiderman took in 238,067 votes, or 49.11 percent. The number of votes separating the two candidates was 8,623.

With roughly 30,000 votes still lingering, Mr. Schneiderman said he does not think he will overtake Mr. Kennedy, but he should be able to narrow the gap.

“It’s important that every vote gets counted,” Mr. Schneiderman said in a press release last week. “I am interested in getting this resolved, however it goes. If and when it becomes statistically impossible for the race to be called in my favor, I would then be prepared to concede.”

The breakdown of the remaining absentee ballots are: 12,950 Democratic, 9,497 Republican, 671 Conservative, 38 Green, 44 Working Families, 1,082 Independence, eight Women’s Equality, five Reform, 111 other, and 5,579 “no affiliation.”

Suffolk County Board of Elections Commissioner Nick LaLota said on Wednesday that in order to ensure the votes are accurate, the state mandates a recount of 3 percent of the roughly 1,500 voting machines in the county—the machines are randomly picked.

He said if there are issues with the audit of the randomly-selected machines, then the Suffolk County Board of Elections will expand the check to 7 percent of the machines, then 10 percent, then 25 percent. He added that he has never seen an issue that has led to a full audit of the votes.

I agree with Supervisor Schneiderman on this. I also voted via an absentee ballot and I want my vote to count. With 30K absentee ballots, and a 9K spread, I would be doing the same thing.

The Newsday endorsement for Kennedy hit the nail on the head about Kennedy's qualifications. It is really a disgrace how close this race is.

Good luck to Jay, but if this goes as expected with a Kennedy win, then Supervisor Schneiderman’s promise to run for re-election next November comes into play. I and others expect him to stand by that promise. Don’t fail us, Jay.

When he answers the question, I will be able to draw a conclusion. When someone leaves a question mark at the end of a sentence it isn’t because they have come to a conclusion. It is an attempt to gain more information from the person the question is being asked to so that a conclusion may be drawn.
