Court dismisses Konrad's claims of defamation

Sep 21, 2010 7:04 PM

The State Supreme Court last week dismissed a defamation lawsuit filed by Southampton Village resident Evelyn Konrad against fellow village resident William Brown over a letter to the editor published in The Southampton Press late last year.

The suit, filed in Manhattan, revolved around Ms. Konrad’s claims that a letter by Mr. Brown in December 2009 was written “wilfully and maliciously” with the intent to damage her reputation as a lawyer. The court’s decision, dated September 10 and signed by Judge Carol Robinson Edmead, rejected those claims.

Mr. Brown had applied to build a house not far from Ms. Konrad’s home. Ms. Konrad, who has filed multiple lawsuits against the construction of what she considers to be McMansions in her neighborhood, wrote a letter published in The Press in December 2009, naming Mr. Brown as the owner of an “overbuilt lot.” In response, Mr. Brown wrote a letter published the following week in which he said Ms. Konrad had made false statements and that she “seems to like suing people.”

The court’s decision stated that the letter “fell within long-running public debates in Southampton that included debate over Ms. Konrad’s litigious approach, which she herself touted.”

konrad is batting 100%. she has run into the brick wall of reality with everyone of her frivolous cases. can someone please move to have her license taken away? was pretty sure this was impossible, but she makes lawyers look bad. being argumentative doesn't make one a good litigator.

I guess the editor prefers blowhard to Nut ball Joe. At least leaving your garage door open all day so everyone can see you have a Mercedes is still allowed. What can you do some folk like being a big fish in a small pond.It is kind of sad actually.

Some lawyer! Why isnt she trying to change the zoning instead of legally harassing individuals building as of right under current guidelines. She totally lacks any real grasp of the law and is using her credentials to harass individuals she doesnt like.
As much as I would like to see her tarred and feathered, as a law abiding citizen I will settle for disbarment.

The offense of frequently exciting and stirring up lawsuits and quarrels is legally termed "barratry''. Something a lawyer should be aware of.

Well, at least this worked out better for the people, than the litigation via the lady who chugged a fresh cup of McD's coffee like a pledge, and his/her first beer...

You all had better watch out. Miss Konrad is going to FOIL the editor to release your names and name you in a class action suit for slander.

C'mon Delta Quadrant, you had to know that would NOT last.

Had to laugh, though...

It seems futile to set you straight, because you still insist that my "long term war"
has been against McMansions. It's true that I don't like huge houses on small
lots, and today, with greater awareness of the damage to the environment from
huge footprints (and added air conditioning, heating, sewage), the taste in our
country has changed drastically, the the Thorsten Veblein competition for
conspicuous consumption is out of favor. Of course, the Southampton Village administration ...more

Right.

I'd be on the same page against excess, and "de pecuniae" segregation myself.

HOWEVER, stop with the frivolity when someone simply has an opinion of your character. Stop wasting time (the court's, yours, and ours) on how people perceive you, or comment about you in "Mouthampton". It's not worth it.

Expend that energy toward the fight against excess instead...

Ms. K.,

Although you feel you are waging a righteous war, I have been in ARB meetings and seen what is going on behind your back. Lets leave it at that.

The ARB has no jurisdiction over the Rosko Farms covenenance. Maybe you should get together with your neighbors to form a homeowners board of Governors.

As for Paul Robinson, has it crossed your mind that the boards had no reason to say no? If his sub division meets all criteria, they have to pass it, no matter how ...more

hey ek, put the pen down, stop typing. its over. nobody's taste for anything is changing anywhere. annoying attorneys are a dime a dozen. when my grandfather was in westhampton care home, they told me that it is a common trait of the elderly to cling onto an idea and not let it go, no matter what. its actually common. think about your legacy, do you really want to become the local punchline to a poorly written gag?
By justduckey (58), artist colony on Sep 28, 10 7:13 AM
Don't tell us what is in or out of favor. It still makes me laugh that your house is by far the biggest of the original development. The homes you protest to are Very tastefully done. The real issue is taxes. Your neighbors have personally told me that these homes raise the property taxes. They same people that are for taxing the rich resent they have become rich. What a riot. as for you I suspect its about getting attention. In any event you lose know go bake some cookies.

Ms. Konrad's actions have required that our village spend hundreds of thousands of taxpayer dollars to defend her self-directed law suits. She has not won a single suit though that has never been mentioned in the self-promoting stories that she obviously prefers be written about her in the newspapers. Bravo to Mr. Brown for telling it like it is and to Judge Carol Edmead for having the spine to rule against one of her own. Brown should be given a Proclamation by the Mayor and Judge Edmead the Keys ...more
