UPDATE: DWI Charges Against East Hampton Real Estate Agent Upgraded

According to East Hampton Village Police, Suffolk County Crime Lab tests revealed that real estate agent Kyle Rosko’s blood alcohol level was more than three times the legal limit when he lost control of his Mercedes Benz and flipped it onto Maidstone Golf Course on Saturday, July 2.

The charges against him have been upgraded from felony driving while intoxicated to felony aggravated driving while intoxicated.

He is scheduled to be arraigned in East Hampton Town Justice Court on Thursday.

ORIGINAL STORY:

The driver of a classic Mercedes was badly injured after he lost control of the vintage car and sent it tumbling onto the grounds of East Hampton’s renowned Maidstone Club golf course on Saturday, July 2.

A Suffolk County Police Department medevac helicopter landed on the golf course and flew the driver, Kyle Rosko, 33, of Montauk to Stony Brook University Hospital to be treated for potentially life-threatening injuries. As of Monday he remained in the hospital in stable condition and was expected to make a full recovery, according to his lawyer, Southampton attorney Colin Astarita.

Mr. Rosko has been charged by East Hampton Village Police with DWI, a felony, because of a prior alcohol related arrest. His lawyer said that police rushed to judgment in filing the charges because they did not conduct a breath alcohol test, due to Mr. Rosko’s injuries, and the results of blood tests have not been determined yet.

He said that Mr. Rosko said he was not intoxicated at the time of the accident, which occurred at about 8 p.m. on Saturday night.

“There has been no mention of why he was charged and absolutely no evidence has been offered to show that alcohol was a contributing factor to this accident,” Mr. Astarita said in a statement on Monday. “Using this line of reasoning it appears that anyone involved in a motor vehicle accident that has any prior history is subject to arrest, which is extremely unfair, as Kyle is a very well-known, well-liked and hard-working young man whose reputation can be affected by this unnecessary rush to judgment.”

East Hampton Village Police said that Mr. Rosko was driving east on Dunemere Lane, near where it becomes Further Lane, at a high rate of speed and failed to negotiate a bend in the road.

Three times the legal limit???? Do you still think the police rushed to judgement? Does your client still think he wasn't drunk? Thank God you didn't hurt anyone else, you jerk!

Exactly. Could have been a fatality very easily. The bar who was serving this moron should have been more proactive.

Felony DWI charges should keep this problem off the road for a while. He can carpool with the "Prince". Reputation my ass. Lawyers. No wonder they invoke such anger.

You're right. It's conceivable that he was at home, decided to start the car at three am, go for a ride to clear his head.

Can we stop saying the driver "lost control" of the car and just say "the drunken driver blacked out / didn't break / etc.. because, you know, he was DRUNK!"
