Oddone To Be Sentenced Wednesday Afternoon

The upstate man who admitted in court last month to killing an off-duty Suffolk County corrections officer during a 2008 Southampton Village bar fight was expected to avoid any additional jail time at his sentencing in Riverhead on Wednesday afternoon.

Anthony Oddone, 32, who formerly lived in Farmingville, pleaded guilty to first-degree manslaughter in Suffolk County Criminal Court on February 19 as part of a plea deal that had been endorsed by the family of the victim, 40-year-old Andrew Reister of Hampton Bays.

Mr. Oddone was convicted of the same charge by a jury in 2009 and sentenced to 17 years in prison, though that conviction was thrown out by the New York State Court of Appeals late last year, sending it back for a retrial. The jury acquitted him of the more serious second-degree murder charge.

Judge C. Randall Hinrichs was expected to sentence Mr. Oddone to five years, four months and 16 days in jail—the exact amount of time he has already served—plus five years of post-release supervision, on Wednesday afternoon. As part of the plea deal, Mr. Oddone also forfeited his right to appeal the plea or the sentence.

Stacey Reister, Mr. Reister's widow, explained last month that the plea agreement was the wish of her family in that it avoided a second trial, which could have spanned several months.

Mr. Oddone was dancing on a low table at the Southampton Publick House when Mr. Reister, who was working as a bouncer, asked him to get down. When Mr. Oddone refused, Mr. Reister pushed him off the table and a fight broke out. Mr. Oddone placed Mr. Reister in a headlock, using his arms to compress the man's neck, and kept his grip even after Mr. Reister fell unconscious, according to witnesses.

Mr. Reister, a father of two, was declared brain dead two days later, having never regained consciousness.
