Open the Road

On Bay View Avenue in Amagansett, we are approaching seven years, eight summers of beach access, having an obstruction not on someone’s property.

Jon Tarbet is the attorney for one of the homeowners who’ve blocked the access to the residents on this road, and the town at large, for 2,518 days as of June 1. The road leads to a town nature preserve (Steele) and thus is “public access” to all.

I was sitting in the local section of the Montauk Library this past weekend, reading “Wetlands: At What Cost?” Here is a good quote that applies: “Nor can I correctly claim the right to use the property of another, not so to restrict his dominion as to deprive him of the full productive use and enjoyment of his land.”

The article just printed alludes to Jon Tarbet paraphrasing that he would think this means the town government would start following the law. I agree. Is that Town Code 91-4, letter G, H, or both? I can name several others that should be enforced against his client.

Time for that 30-foot stretch of road to be open again and an illegal obstruction removed.
