State Supreme Court Justice Joseph A. Santorelli issued a final determination on July 20, granting my petition against the Town Board of the Town of Southampton and annulling Town Board Resolution 2020-288, dated February 25, 2020, in which the Town Board formally adopted the Hampton Bays Downtown Overlay District form-based code.

I am not an attorney, but I believe that this final determination puts the brakes on the Town Board’s plan to move forward on the implementation of the overlay district. It also may require the Town Board to rescind any resolutions that were predicated on it, including the referendum for the alienation of parkland for the Good Ground Road extension.

I hope now that the Town Board will use this court-mandated pause not to dig in their heels and try to file an appeal or to “slice and dice” some facts and figures to support this high-density development, but instead to fulfill its responsibility and obligation to the residents of Hampton Bays for a transparent process that results in an overlay district that is consistent with the Hampton Bays Corridor Strategic Plan and truly environmentally sustainable for our hamlet.
