Ihor Sovtan, 54, of East Northport was charged by East Hampton Town Police with felony DWI early Friday morning. Police said Sovtan was driving a 2014 Nissan suburban on Old Montauk Highway in Montauk, moving at 52 mph in a 30-mph zone, leading to the traffic stop. He appeared intoxicated, the arresting officer reported, and failed roadside sobriety tests, after which he was placed under arrest. Sovtan refused a breath test at headquarters, leading Justice David Filer to suspend his driver’s license during a Friday noon arraignment. The charge against Sovtan is a felony because he was previously convicted in November 2017 of DWI, also at the felony level. That 2017 conviction was a felony because Sovtan had yet another DWI conviction less than 10 years before. A DWI charge becomes a felony if the defendant has been convicted of DWI during the proceeding 10 years from the date of the arrest. In all, prosecuting attorney Keith O’Brien said during Sovtan‘s arraignment, Sovtan has two prior felony convictions for DWI and one misdemeanor DWI conviction. Because of the multiple felony convictions, he was remanded to county jail. Bail can be set in such cases only in Suffolk County Court. The district attorney’s office had until the end of business on Wednesday to either obtain an indictment from a grand jury on the felony charge against Sovtan or release him from custody, as is required by the laws covering such circumstances. Sovtan remained in County Jail in Yaphank as of Wednesday morning.
Theodore M. Tomao, 33, of Laurel was arrested by Town Police on a misdemeanor DWI charge on Monday night. Police said he was driving a 2017 Toyota on Fort Pond Boulevard and Springs Fireplace Road in Springs in an erratic manner, including swerving across the double yellow line, leading to the traffic stop. Failing sobriety tests, police said, Tomao was placed under arrest. At headquarters, police said, he refused to take a breath test, and he had his license suspended the next morning during his arraignment.
Karen Jessenia Quizhpe Carci, 25, of Hampton Bays was arrested on Friday night on a misdemeanor DWI charge by Town Police after reportedly running a stop sign on Abraham’s Path in East Hampton while driving a 2021 Toyota pickup truck, Town Police said. She appeared intoxicated and failed sobriety tests, according to police, leading to her arrest. At headquarters, Quizhpe Carci consented to take a breath test, which produced a reading of .15, almost twice the .08 mark that defines intoxication in the State of New York, according to police. Quizhpe Carci was also charged with misdemeanor unlicensed driving.
Patrick J. Irwin, 35, of East Patchogue was charged with misdemeanor DWI on Saturday night by Town Police after an accident on South Euclid Avenue in Montauk. Police said Irwin was driving a 2004 Cadillac Escalade when he struck a parked vehicle. The officer who interviewed Irwin had him take a roadside sobriety test, which Irwin reportedly failed. He was taken to police headquarters where a breath test reportedly produced a .15 reading.
Milton German Anguisaca Buestan, 28, of Springs was charged with misdemeanor DWI the night of April 30. Police said he was pulled over by the arresting officer on Abrahams Path in East Hampton while driving a 2008 Jeep because he was swerving across lane lines, and also had a suspended registration, leading to an additional violation charge. He failed sobriety tests and was placed under arrest, police said. After being taken to police headquarters. Anguisaca Buestan took a breath test, police said, producing a reading of .11. During Anguisaca Buestan’s arraignment last Thursday, the prosecution pointed out that he had a prior conviction at the violation level for driving with ability impaired by alcohol. East Hampton Town Justice David Filer declined the prosecution’s request to require Anguisaca Buestan to report to the probation department to be fitted with a SCRAM bracelet but told the defendant that he would monitor his progress and would not hesitate to revisit the question if Anguisaca Buestan were to have any further brushes with the law.
